TERMS & CONDITIONS – LIVER ART COMPANY

1. General Provisions

This website, liver.am (the "Website"), is operated by Liver LLC ("Company", "we", "us", "our").

LIVER Art Company provides art-related services and presents artworks by Armenian and international artists, including paintings, sculptures, photography, graphic works, and decorative and applied art.

By accessing the Website or purchasing an artwork, you agree to these Terms & Conditions. If you do not agree, please do not use the Website.

2. Eligibility

  • You must be 18 years or older to purchase an artwork through the Website.
  • By using the Website, you confirm that you have the legal capacity to enter into binding agreements.

3. Artworks

  • Each artwork is an original work unless otherwise expressly stated in its description.
  • Artwork descriptions may include information about the artist, title, year of creation, technique, materials, dimensions, and other relevant details.
  • Due to the individual nature of artworks, minor differences between photographs displayed on the Website and the physical artwork may occur, including differences in color caused by photography, lighting, or screen settings.
  • Dimensions indicated in product descriptions refer to the artwork itself unless otherwise stated.
  • Frames, stands, mounting systems, or other accessories are included only when explicitly specified in the artwork description.
  • Some artworks may show natural characteristics resulting from their materials, age, technique, or method of creation. Such characteristics are not considered defects.

4. Pricing & Payments

  • All prices are displayed in AMD and include applicable taxes unless otherwise stated.
  • Accepted payment methods include card and bank transfer.
  • Full payment is required before an artwork is released for delivery or collection.
  • An artwork is considered sold only after the payment has been successfully received and confirmed by the Company.

4.1 Online Card Payments

All online card payments are processed through secure payment systems and may require 3D Secure authentication.

The customer may be redirected to the bank's secure payment environment, where cardholder authentication is completed using a one-time password (OTP) or another verification method provided by the bank.

The Company does not store or have access to the customer's full card details during the payment process.

5. Artwork Availability

  • Each artwork is subject to availability.
  • Because many artworks are unique or one-of-a-kind, an artwork may become unavailable before the Website information is updated.
  • In the event that an artwork is no longer available after an order has been placed, the Company will contact the customer and arrange a refund of the amount paid.
  • The Company reserves the right to correct pricing, description, availability, or other information displayed on the Website in case of an error.

6. Shipping & Delivery

  • Delivery is available within Armenia, unless otherwise agreed with the Company.
  • Delivery within Yerevan is completed within 1 business day, unless another delivery period is specified for the particular artwork.
  • Delivery outside Yerevan is generally completed within 3–5 business days.
  • Delivery fees are communicated to the customer before the order is finalized.
  • The customer must provide accurate delivery information.
  • The customer is responsible for ensuring that the delivery address is accessible and that someone is available to receive the artwork.
  • Risk of loss or damage passes to the customer upon delivery and acceptance of the artwork.

7. Artwork Collection

Where available, customers may arrange to collect an artwork directly from the location specified by LIVER Art Company.

The artwork may only be released after payment has been received in full.

The customer is responsible for ensuring appropriate transportation and handling of the artwork after collection unless otherwise agreed with the Company.

8. Returns & Refunds

  • A return request may be submitted within 14 days of delivery, subject to the conditions below.
  • The artwork must be returned unused, undamaged, and in its original condition, with all original packaging and accompanying documentation preserved.
  • The customer must provide proof of purchase/payment receipt.
  • The artwork must not have been altered, reframed, restored, modified, or otherwise handled in a way that changes its original condition.
  • Return transportation costs are borne by the buyer, unless the return is due to an error attributable to the Company.
  • All returned artworks are subject to inspection before a refund is approved.

8.1 Non-Returnable Cases

A return may not be accepted if:

  • the artwork has been damaged after delivery;
  • the artwork has been altered or modified;
  • the artwork has been improperly stored, transported, displayed, or handled;
  • the original packaging or accompanying documentation is missing where such materials were provided;
  • the artwork was specially commissioned or created according to the customer's individual requirements.

9. Order Cancellation & Refund

In case of cancellation of a purchase made through the Website, the refund will be processed within up to 14 business days, subject to the applicable return conditions.

The refund will be made using the original payment method, unless otherwise agreed or required by the applicable payment provider.

For bank transfer payments, the Company may request the necessary bank account information to process the refund.

10. Authenticity & Documentation

  • Where applicable, artworks are accompanied by documentation confirming relevant information about the artwork and/or artist.
  • The Company provides available information regarding the artist, title, date, technique, materials, dimensions, and provenance of the artwork.
  • Any certificate of authenticity, artist documentation, provenance documentation, or other accompanying documents will be provided where applicable.
  • The absence of a separate certificate does not necessarily mean that an artwork is not original.

11. Artwork Condition

The condition of each artwork is assessed and described based on the information available to the Company.

For older or previously exhibited artworks, signs of age, use, restoration, or previous display may exist and will be communicated where relevant.

Customers may request additional information or photographs regarding the condition of an artwork before completing a purchase.

12. Care & Preservation

The customer is responsible for the appropriate care and preservation of the artwork after delivery.

Depending on the technique and materials, artworks may require protection from:

  • direct sunlight;
  • excessive humidity or moisture;
  • extreme temperatures;
  • dust, chemicals, or other damaging substances;
  • improper hanging, installation, or storage.

Damage resulting from improper handling, transportation, storage, installation, or care is not considered a defect attributable to the Company.

13. Intellectual Property

  • Copyright and other intellectual property rights relating to an artwork remain with the artist unless otherwise expressly agreed.
  • The purchase of a physical artwork does not automatically transfer copyright, reproduction rights, commercial rights, or other intellectual property rights to the buyer.
  • All Website content, including photographs, texts, logos, graphics, designs, and product descriptions, is protected by applicable intellectual property laws.
  • Unauthorized copying, reproduction, distribution, or commercial use of Website content is prohibited.

14. Limitation of Liability

  • The Website and its content are provided on an "as is" basis.
  • LIVER Art Company is not liable for indirect, incidental, or consequential damages arising from the use of the Website or purchase of an artwork, to the extent permitted by applicable law.
  • The Company is not responsible for damage resulting from improper transportation, installation, storage, handling, or care after delivery or collection.

15. Data Security & SSL Protection

The Website uses SSL (Secure Socket Layer) encryption technology to help protect information transmitted between the user and the Website.

The Company takes appropriate technical and organizational measures to protect customer information against unauthorized access, alteration, disclosure, or destruction.

16. Governing Law

These Terms & Conditions are governed by the laws of the Republic of Armenia.

Any disputes arising from or related to the Website, services, or purchase of an artwork shall be subject to the jurisdiction of the competent courts of the Republic of Armenia.

17. Amendments

LIVER Art Company reserves the right to modify these Terms & Conditions at any time.

Any changes become effective upon publication on the Website.
